Business Ombudsman Council as an independent permanent advisory body of the Cabinet of Ministers of Ukraine was initiated after the Revolution of Dignity in 2014. The institution’s mission is to help establish a transparent business environment through protecting entrepreneurs’ rights from state officials’ malpractice and thus prevent corruption in state bodies, local government authorities and in state-owned enterprises.
Business Ombudsman Council is meant to be the first point of contact for companies seeking redress against unfair treatment. BOI serves as an impartial and alternative mechanism of protecting the rights and interests of business entities and facilitates their dialogue with state authorities. The most widespread reasons for international and local complaints addressing the BOC are tax issues, actions of law enforcers and state regulators and actions of local government authorities.
The Business Ombudsman Council is financed from the Ukraine Stabilization and Sustainable Growth Multi-Donor Account (MDA) managed by the EBRD. Contributors to the MDA are Denmark, Finland, France, Germany, Italy, Japan, the Netherlands, Norway, Poland, Sweden, Switzerland, the United Kingdom, the United States and the European Union, the largest donor.
Roman Waschuk is a Ukrainian Business Ombudsman since January 1, 2022. Mr. Waschuk is a former Canadian diplomat, served as Ambassador of Canada to Ukraine 2014-2019. Currently, the Council’s team consists of 40 people: experts with mostly western education and practical experience in law, economics, auditing, and risk management. Deputy Business Ombudsman/Chief Legal Officer will be responsible for the structuring and conducting of investigations into allegations of business malpractice and the preparation of systemic advice to governmental authorities designed to improve the investment climate.
Key Accountabilities and Responsibilities:
• Ensure that the BOC builds and maintains appropriate legal resources and expertise and maintains at all times effective policies and procedures.
• Ensure that all BOC investigations are completed within the expected timeframe and investigation reports are completed to a high standard. Ensure that investigative findings and conclusions are appropriate and sufficiently supported.
• Provide senior legal advice to the Business Ombudsman and other stakeholders.
• Lead and assist the BO with high-level legal dialogue and cooperation with other institutions, national and international organizations in areas of ethics, investigations and compliance. Where relevant, actively contributes to international cooperation designed to further combat corruption and/or other violations of the legitimate interests of businesses.
• Lead and manage professional legal staff in the BOC and ensure efficient, effective and consistent performance by such personnel.
Required Qualifications, Experience and Knowledge:
• Solid career track record in legal sphere. Substantial degree of relevant professional experience with appropriate degree of seniority.
• Acknowledged within the business community as being of impeccable standing, both professionally and personally.
• Successful management of diverse teams and practice areas.
• Ability to lead or direct and coordinate the decision-making processes in public and private organizations.
• Proven ability to make well-reasoned and considered judgement in complex situations.
• Proven expertise in conducting and managing complex investigations.
• Ability to handle pressure, to work to challenging deadlines, and with a positive problem-solving attitude.
• Excellent command of English and Ukrainian with ability to communicate and write clearly and concisely in these languages.
