Ilyashev & Partners Secures Provisional Anti-Dumping Duty on Radiators from Turkey and China

Ilyashev & Partners' International Trade team, headed by Olena Omelchenko, Partner, has successfully obtained provisional anti-dumping measures on the import of heating radiators from the Republic of Turkey and the People's Republic of China to Ukraine. The team represented San Teh Rai LLC and Uterm Ukraine LLC, the national manufacturers.

Following the interim review of the anti-dumping investigation, the Interdepartmental Commission on International Trade issued Decision No. AD-568/2024/441-01 dated 15 October 2024, decided to apply a provisional anti-dumping duty on goods from the Republic of Turkey and the People’s Republic of China with the following description: heating radiators (steel, aluminium, bimetallic), classified under the Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA) codes 7322 19 00 00, 7616 99 10 00, 7616 99 90.   

The rate of the provisional anti-dumping duty on imports of goods into Ukraine is set at:

  • 41.86% for manufacturers and exporters of heating radiators originating from the Republic of Turkey;

  • 42% for manufacturers and exporters of heating radiators originating from the People’s Republic of China. 

However, the measures will not apply to heated towel rails, water underfloor heating systems and designer radiators (i.e. vertical and horizontal tubes).

The investigation showed that since 2023, a number of financial and economic indicators including production and sales volumes, capacity utilisation, employment rates and enterprise revenues have significantly worsened for national producers.   

“Ukrainian companies have been waiting for this very important decision for a long time. The complaint was originally filed with the Ministry of Economy in 2020. Since Turkey and China have been dumping imports for a long time, emergency safeguard measures were required,” Olena Omelchenko said. “The decision to impose provisional measures coincided with the extension by the European Commission of definitive anti-dumping duties ranging from 12.6% to 56.2% on imports of aluminium radiators from China to the EU. The Interdepartmental Commission decision is another proof of unfair competition among Chinese producers and exporters.”

The provisional anti-dumping duty is introduced for four months and will be charged from the date of publication of the relevant Interdepartmental Commission decision in the Uriadovyi Kurier. The provisional anti-dumping duty will be levied by the customs authorities regardless of the payment of other taxes and fees (mandatory payments) and import duties.

The decision to initiate an anti-dumping investigation based on the results of consideration of the complaint filed by San Teh Rai LLC and Uterm Ukraine LLC, the national producers, prepared by Ilyashev & Partners’ International Trade team, was made by the Interdepartmental Commission on International Trade on 12 April 2024.
