On 22 June 2020 the District Administrative Court of Kyiv suspended the order of the General Director of Ukroboronprom, Aivaras Abromavičius, dated 15 June 2020 on dismissal of the President of the strategic State Enterprise Antonov, Oleksandr Donets. This was reported by the press service of the well-known Ilyashev & Partners Law Firm, defending the interests of SE Antonov.
It should be recalled that earlier the District Administrative Court of Kyiv granted the motion of O. Donets in legal action as regards the unlawful nature of the order of A. Abromavičius dated 9 June 2020 to terminate the powers and authority of the President of the aircraft building enterprise.
After the court decision of 15 June 2020, A. Abromavičius publicly admitted that his order to dismiss O. Donets was unlawful and has canceled it on his own accord. However, on the same day, 15 June, ignoring the prohibition of the court, A. Abromavičius re-issued an order to terminate the powers of the President of the SE Antonov.
“The court agreed with our arguments that, just like the previous decision issued to terminate the powers and authority of the head of SE Antonov, the decision of Ukroboronprom that followed was taken outside the concern’s authority, – commented the Senior Partner of Ilyashev & Partners, an Honored Lawyer of Ukraine Roman Marchenko. – The unlawful actions of a Lithuanian citizen A. Abromavičius are qualified under Article 172 of the Criminal Code of Ukraine as a gross violation of labor law, which is punishable by correctional labor for a term of up to two years or arrest up to six months”.
It bears reminding that in response to the unlawful dismissal of Oleksandr Donets, the labor collective of the SE Antonov held an open meeting on 9 June and petitioned the state leaders to withdraw the SE Antonov from the incompetent management of A. Abromavičius.
As of today (24 June 2020), according to the State Register, the aircraft building enterprise is headed by Oleksandr Donets (according to Article 10 of the Law of Ukraine On the State Registration of Legal Entities, Individual Entrepreneurs and Public Organizations, the information entered in the Unified State Register is considered reliable).
