A foreign ship agent filed a request to Interlegal on debt recovery for agency services.
Interlegal, acting in the Client’s interests, filed a claim to the Ukrainian court on debt recovery. But the court stated that the dispute should not be settled by the Ukrainian courts, since non-resident parties failed to provide the Ukrainian jurisdiction.
The first instance court rejection of case acceptance for consideration was successfully appealed against. Interlegal senior lawyer Alexey Remeslo and lawyer Vitalii Tolstik justified the Ukrainian jurisdiction at the court of appeal by proving the debtor’s property location in Ukraine, while the first instance court ignored this fact.
